But the fruity-named firm actually shipped the same update to both older and newer devices, with some of them getting significantly slower than expected, despite the company’s promise of better performance. A group of approximately 100 iPhone 4s owners decided to start a legal action against Apple for providing misleading information about iOS 9, as their devices ended up running the new operating system without the promised performance boost. No downgrade is possible While iOS 9 is mostly a worthy update for iPhone 6 and newer, there’s no doubt that owners of older models also expected to get access to new features with this new release. Apple itself explained that even if you own an older iPhone, you could still update to iOS 9 and receive some features, but stated that a number of options would be removed because of the limited hardware capabilities. But a performance increase was expected, Apple said, so this group of people claim in the lawsuit filed in a New York court that Apple lied about the iOS 9 update. They now have to buy new phones, the documents read, while also pointing to some statements made by Apple during the iOS 9 advertising push, where the company emphasizes that its new OS version is faster than its predecessors. Apple doesn’t specifically mention iPhone 4s as one of the models to benefit from a huge performance boost, but this is one of the versions getting the update, and at some level, it’s not hard to understand these people’s frustrations. What’s more, many are upset that Apple does not allow them to downgrade their devices to an earlier version of iOS, which keeps their iPhones completely unusable, they say. Apple has not yet responded to these claims, but it’s not the first time the company is accused of such a thing, so it’s probably just a matter of time until the lawsuit is either dismissed or a settlement is reached.
